Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Kashi mobile application made available via the Apple Inc. App Store and related services (the "Services"), provided by Otajon Ruzimov ("Company," "we," "our," or "us").

By downloading or using the Services, you agree to these Terms.
If you do not agree, do not use the Services.

1. Agreement with Apple

• These Terms are between you and Kashi, not Apple.
• Apple is not responsible for the Services or their content.
• Apple has no obligation to provide maintenance or support.
• In the event of a failure to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any).
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them.

2. Eligibility

You must be at least 18 years old or the age of majority in your jurisdiction.

By using the Services, you represent that:

• You have legal capacity to agree to these Terms
• You will comply with applicable laws
• You will provide accurate information

3. Description of Services

The App is an AI-powered voice expense tracking application that:

• Converts voice input into text using speech recognition
• Categorizes expenses using machine learning
• Provides analytics, summaries, and budgeting insights

The Services are informational only and do not constitute financial, tax, accounting, or legal advice.

4. AI Disclosure & Transparency

The Services use automated decision-making and artificial intelligence systems.

You acknowledge:

• AI-generated categorizations may not be accurate.
• Outputs are probabilistic and may contain errors.
• You are responsible for reviewing and verifying expense data.
• We may improve our AI models using anonymized or aggregated data.

5. User Accounts

You are responsible for:

• Maintaining account security
• Keeping credentials confidential
• All activity under your account

We may suspend or terminate accounts for violations.

6. Subscriptions & Billing

Available Plans

Kashi App offers the following premium subscription plans:

• Premium Monthly: $2.99 per month
• Premium Yearly: $24.99 per year

Billing & Payment

• All payments are processed securely by Apple through the App Store.
• Payment is charged to your Apple ID account at confirmation of purchase.
• We do not directly collect, store, or process your payment information.

Auto-Renewal

• Subscriptions automatically renew at the end of each billing period unless canceled.
• Your account will be charged for renewal within 24 hours before the end of the current period.
• The renewal price will be the same as the original subscription price unless you are notified otherwise.

Cancellation

• You may cancel your subscription at any time through your Apple ID account settings.
• Cancellation must be made at least 24 hours before the end of the current billing period to avoid being charged for the next period.
• After cancellation, you will retain access to premium features until the end of the current billing period.
• Cancellation does not entitle you to a prorated refund for any unused portion of the current period.

Refunds

• All refund requests are handled by Apple in accordance with the App Store refund policy.
• We do not have the ability to issue refunds directly.

Price Changes

• We reserve the right to modify subscription pricing at any time.
• You will be notified of any price changes in advance and will have the option to cancel before the new pricing takes effect.

7. Acceptable Use

You agree not to:

• Use the Services for illegal activity
• Attempt to reverse engineer the App
• Upload malware
• Interfere with service integrity
• Misuse AI systems

8. Intellectual Property

All software, AI systems, content, branding, and materials are owned by or licensed to the Company.

You are granted a limited, non-transferable, revocable license for personal use.

9. Third-Party Services

The App may rely on:

• Cloud infrastructure providers
• AI processing services
• Analytics providers
• Payment processors (via Apple)

We are not responsible for third-party services.

10. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE."

We disclaim all warranties, including:

• Accuracy of AI outputs
• Fitness for a particular purpose
• Uninterrupted or error-free service

11. Limitation of Liability

To the maximum extent permitted by law:

• We are not liable for indirect, incidental, or consequential damages.
• Total liability is limited to the greater of:
  • Amount paid in the last 12 months
  • USD $100

Some jurisdictions may not allow limitations.

12. Indemnification

You agree to indemnify the Company against claims arising from:

• Your misuse of the Services
• Your violation of law
• Your breach of these Terms

13. International Use

We operate globally. You are responsible for compliance with local laws.

If you are in the European Economic Area (EEA), UK, or Switzerland, additional rights under local data protection laws apply (see Privacy Policy).

14. Termination

We may suspend or terminate access:

• For violations
• If required by law
• If we discontinue Services

15. Governing Law

These Terms are governed by the laws of:
Delaware, USA

If you reside in the EU/UK, mandatory consumer protections under your local law apply.
